Biden ‘not prepared’ to leave right to privacy determination to ‘whims’ of ‘local areas’

The president went on to say that “one of the reasons” why he voted against “a number of members of the Court” was because “they refuse to acknowledge that there’s a 9th Amendment." 

The Ninth Amendment states that the "enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”

According to the Annenberg Classroom, the Ninth Amendment is a “constitutional safety net intended to make clear that individuals have other fundamental rights, in addition to those listed in the First through Eighth Amendments.”<- WRONG!

“They refuse to acknowledge there’s a right to privacy,” the president said Tuesday. “I mean, there are so many fundamental rights that are affected by that.”

Our “President” apparently knows what the 9th Amendment says, but doesn’t fucking understand how the Constitution even fucking works!

The Constitution DOES NOT FUCKING DEFINE THE RIGHTS OF THE PEOPLE!

The Constitution DEFINES THE FUCKING LIMITATIONS OF THE GOVERNMENT OVER THE PEOPLE!

The 9th Amendment RESTRICTS THE GOVERNMENT FROM LEGISLATING AWAY OR PUNISHING USAGE OF THE FREEDOMS OF THE PEOPLE!

What the 9th Amendment says is that all people, right down to the medically accepted point of individuality (e.g. Fetus with brain activity), cannot be denied their Freedoms based upon the rights passed to the Government. Let’s put this into context, shall we?

The Government has a right to enact laws. So in doing, the 9th Amendment prohibits the Government from enacting a law that prohibits all Citizens from voting. Under another Amendment, there’s a prescribed remedy to strip or restrict specific criminal offenders from voting. Because of the latter, the former cannot be construed as a rational reason to restrict a broader scope of criminal offenders from voting.

How about this one then?

The Government can enforce capital punishment as prescribed by law for specific criminal offenders. However, there are no Amendments that allow the Government to enforce capital punishment on all criminal offenders. Therefore, the states retain that power. They can enforce capital punishment at the state level, even down to the local level unless laws prohibit or delegate it to the state. Yet, abortion cannot be enforced by any local, State, or the Federal government, because that would be capital punishment of a non-entity until such time as birth, according to another Amendment regarding Citizenship by Birth.

You see how the 9th Amendment works?
